EPO rules Claudius Peters ETA Cooler patent as valid

Claudius Peters announced today the European Patent Office has rejected KHD’s opposition against the European patent for the cooling process of Claudius Peters’ ETA Cooler.

Pursuant to a hearing on September 30, 2010, the Opposition Division held the protected method as being novel and inventive, thereby delivering a potentially heavy blow to KHD who failed with all their arguments including an opinion from an allegedly independent expert.

A spokesperson for Claudius Peters said “We are very pleased that the Office recognized and acknowledged our patent as valid. Of course, the decision can be potentially appealed, but we are very confident that it will be upheld by the Board of Appeal.”
